Terms and Conditions of Ritual Facilitator Kaj van der Plas

Below you can read what you can expect from me and what I expect from you if you 'hire' me in my role as a ritual facilitator.

When I write 'you', 'your', etc., I mean you as the client. When I write 'I' or 'me', etc., I mean Ritual Facilitator Kaj van der Plas. The following is therefore about you and me as parties to the agreement we enter into.

1. About these conditions

By entering into an agreement with me verbally or in writing, you indicate that you also agree to the terms and conditions below. I send them with my quote and/or order confirmation, and publish them on my website.

If you enter into the agreement with me on behalf of others, the terms and conditions also apply. I assume that you will discuss them with those others in advance if necessary.

2. I keep confidential what is confidential

In order to serve you well, it may sometimes be necessary to talk about confidential matters. Rest assured, I am obliged to maintain confidentiality of everything that has come to my knowledge as confidential and everything that is normally supposed to be confidential.

Confidentiality remains in effect even after the assignment is completed.

I make an exception to this. If confidentiality in the short or long term could lead to life-threatening situations for you or others, or if you or others suffer damage due to confidentiality, I may break that confidentiality. I will then carefully and with integrity follow the designated paths.

3. This applies to my rates

Because I make a living with this work, it is important to properly record both the rates and the payment.

We agree on a rate for the assignment in advance. This can be one of the standard rates as stated on the website, or the hourly rate, or a combination of a standard rate and the hourly rate.

If you give me the assignment without us having agreed on a rate in advance, the standard rate applies for the service for which you have engaged me, or the hourly rate of 75 euros per hour, or a combination of the standard rate and the hourly rate. The costs for my services as a ritual facilitator are exclusive of VAT (no VAT needs to be paid for ritual facilitation).

I will charge you separately for travel expenses. The meter starts running from 35 kilometers from my address in Groningen.

4. How you can pay me

As soon as you pay me, you do so via a bank transfer. I do not accept cash payments (that causes too much hassle and I have to write receipts and so on). Transfer the amount to account number NL75 KNAB 0256 9479 02 in the name of Kaj van der Plas, and state the invoice number.

In order to keep my administration running, you must pay within 14 days of the invoice date. If, despite our agreements, you object to the amount charged, you must still pay on time. We will of course discuss this with each other.

If you hire me through the funeral director, my invoice may go to him or her. My fee is then part of the bill you receive from the funeral director.

If you hire me on behalf of others, and those others do not have enough money to pay the invoice, you are responsible for paying the invoice. So check in advance.

5. If you want to cancel or change

Have you changed your mind after giving me the assignment? That can happen. If you cancel the assignment, you pay for the hours I have worked up to that point, at the applicable hourly rate.

If you change the assignment in the sense that you reduce it, you pay for the hours I have worked up to that point, at the applicable hourly rate. These hours, plus the time still needed to properly complete the changed assignment, together form the invoice.

6. I do what I can

I will carry out the assignment for you to the best of my ability and knowledge. If it does not have the result you intended, you cannot invalidate our agreement on that basis.

I need correct, complete and reliable information to properly carry out my assignment. Also if you enter into the assignment with me on behalf of others. You are responsible for this as the client. If something goes wrong when carrying out the assignment and you blame me for it? My liability is limited to the amount we agreed for the assignment.

7. Outsourcing

If I think it is necessary, I can also outsource the assignment or parts thereof to or have it performed by third parties who are not employed by me. You can assume that I will discuss this with you first, but even if it happens without your permission, our agreement is still valid.

8. Force majeure and calamities

I commit to fulfilling agreements made and carrying out the assignment to the best of my ability and knowledge. Unless there is force majeure. Force majeure is when I am unable to fulfill my side of our agreement due to urgent circumstances such as fire, an energy or internet outage, non-delivery or late delivery by suppliers or other engaged parties.

There is also force majeure if I become ill or if serious calamities occur in my private life.

In the event of force majeure, I will (have someone) inform you as the client as soon as possible. In the event of illness or serious calamities in my private life, I will try to find suitable replacement in consultation with you.

9. Intellectual property

What I make or write for you remains my intellectual property in the eyes of the law. Of course, it is at your disposal after the assignment is completed. But I retain the rights to the material I have produced (especially with regard to what is mentioned in Article 10 of the Copyright Act).

What should you think about? For example, you may not simply use a speech that I have written for you (or give it to someone else to use) during an occasion other than the one for which the text was created. Please discuss it with me first. And if, for example, I have come up with a beautiful sentence or other beautiful element in a speech or something else that I make for you, I can reuse it at another time or in another place. Think of publishing a list of '10 beautiful metaphors for a funeral speech'.

If I quote from existing work, I commit to doing so in such a way that there is no connection whatsoever between the quote and the person or persons who were involved in the creation of the text or work, or who were the subject in the text or work.

10. Recording and distribution

My work may be recorded in image and sound, as part of the recording of a ceremony, and also be multiplied and distributed among those directly involved as part of that recording. Permission must be requested from me for distribution outside the circle of those directly involved, or the use of the recordings for other purposes.

11. Finally

Dutch law applies to every agreement between me and you.
